Terms of Service — CalSnapp

1. Who we are

CalSnapp ("CalSnapp", "we", "us") is operated by Jose Antonio Villazon Maroney (the "Seller"). By using CalSnapp you are contracting with the Seller.

2. Acceptance of terms

By creating an account or continuing to use CalSnapp you agree to these Terms. If you do not agree, do not use the service.

3. The service

CalSnapp is an AI-powered nutrition tracker that estimates calories and macronutrients from food photos and offers an AI nutrition coach. Estimates are approximate and provided for informational purposes only — they are not medical, dietary, or professional advice. Always consult a qualified professional for health decisions.

4. Acceptable use

You must not misuse the service. In particular you agree not to: (a) use the service for any unlawful purpose, fraud, or spam; (b) infringe anyone's intellectual property or privacy rights; (c) interfere with the security or integrity of the service (including malware, scraping, or probing); (d) attempt to reverse engineer, resell, or redistribute the service; or (e) submit content you do not have rights to.

5. Accounts

You are responsible for the activity under your account and for keeping your credentials confidential. You must provide accurate information and keep it up to date.

6. Intellectual property

The CalSnapp service, its software, branding, and content are owned by the Seller and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the service under your chosen plan. You retain ownership of the photos and content you submit, and grant us a limited license to process them solely to provide the service.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. You can cancel at any time via the subscription portal in the app.

9. Service availability

We do our best to keep CalSnapp running, but we do not guarantee that the service will be uninterrupted, error-free, or always accurate. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service will not exceed the amount you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Suspension and termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the service at any time. On termination, your right to use the service ends and we may delete your data after a reasonable period.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Seller's jurisdiction, without regard to conflict-of-laws principles. Disputes will be resolved by the competent courts of that jurisdiction, except where mandatory local consumer law provides otherwise.
